Terms of use

1. Purpose and acceptance

Version 2.0 — Effective 25 July 2026
These Terms of Use ("Terms") govern access to and use of the Wenly mobile app and the wenly.fr website (together, the "Service"), published by Mathis Laversin, sole trader trading as Agence Fluid ("we", "the Publisher"), SIRET 101 325 017 00016, France.
Creating an account constitutes full acceptance of these Terms. If you do not accept them, you must not use the Service.
These Terms are supplemented by:
- the Terms of Sale (https://wenly.fr/en/terms-of-sale), which apply if you subscribe to Premium;
- the Privacy Policy (https://wenly.fr/en/privacy-policy);
- the Legal information page (https://wenly.fr/en/legal-informations);
- for iOS users, Apple's standard Licensed Application End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Where that agreement and these Terms conflict as to the licence to use the iOS app, Apple's agreement prevails.

2. Description of the Service

Wenly is a menstrual cycle tracking and couple-sharing app. It lets you log your periods, symptoms, needs, moods and libido levels, obtain indicative predictions, and share some or all of this information with a partner linked via a pairing code.
Some features are available free of charge. Certain advanced features are reserved for Premium subscribers, under the conditions described in the Terms of Sale.

3. Medical disclaimer

Wenly is not a medical device within the meaning of Regulation (EU) 2017/745, nor is it a medical device under the laws of any other jurisdiction.
The Service is a tracking and information tool provided strictly for guidance. It cannot be used to diagnose, prevent, monitor or treat any condition.
The Service is in no way a method of contraception, nor a fertility treatment aid. Cycle and fertile-window predictions are based on a statistical calculation from the data you enter; their reliability depends on the regularity of your cycle and the accuracy of your entries. They may be wrong.
For any decision relating to your health, contraception or fertility, consult a qualified healthcare professional. If you experience an unusual, painful or persistent symptom, seek medical advice without delay.

4. Access conditions

4.1 Minimum age
The Service is intended for people aged 15 and over. By creating an account, you declare that you have reached this age. We do not collect your date of birth and therefore cannot verify this declaration. We reserve the right to delete any account we learn was created in breach of this rule.


4.2 Account creation
Creating an account requires a valid email address or the use of Apple or Google sign-in. You undertake to provide accurate information and keep it up to date.
You are solely responsible for keeping your credentials confidential and for all activity carried out from your account. Notify us without delay at contact@wenly.fr in the event of unauthorised use.
An account is strictly personal and may not be shared, transferred or resold.


4.3 Equipment
Access to the Service requires a compatible device, a supported operating system version and an internet connection. These are your responsibility.

5. Account pairing

Pairing lets you link your account to another person's using a code you send them.
By enabling pairing, you expressly consent to sharing with that person your cycle calendar and its predictions, your symptoms, needs, moods and libido levels, the notes you have marked as shared, the joint Bucket List, and your username and profile picture. Premium status is shared between both linked accounts: if either partner subscribes, the other benefits from Premium features for the duration of the link. Your email address, credentials, unshared notes and billing details are never shared.
The pairing code should be shared with care, and only with someone you trust. We cannot verify the identity of the person who uses it.
Breaking the link: either partner can break the link at any time, unilaterally and without notice, from Settings > My couple. The break takes effect immediately and deprives the former partner of all access to all of your data, including data relating to the paired period. Content created together stops being accessible to both accounts, and shared Premium access ends for the non-subscribing partner.
Please note that no technical measure can prevent a partner from keeping a copy outside the app (screenshot, photograph, memorisation) of information viewed before the link was broken.

6. User content

You retain all rights in the content you create in the Service (notes, Bucket List, profile picture, the "Content").
You grant us a licence strictly limited to hosting, storing, technically reproducing and displaying that Content, solely in order to provide you with the Service and to transmit it to the partner you have linked. This licence is free of charge, non-exclusive, and ends when the Content or your account is deleted. We do not exploit your Content for any other purpose, and in particular not for advertising, promotion, or training artificial intelligence models.
You undertake not to publish Content that is:
- unlawful, defamatory, insulting, threatening or harassing;
- an infringement of a third party's privacy or rights;
- hateful, discriminatory or inciting violence;
- pornographic or depicting minors;
- an infringement of intellectual property rights;
- malware or unsolicited advertising.
Reporting: if you are subjected to abusive content from a linked partner, you can break the link immediately from settings and report the situation to contact@wenly.fr. We handle every report within 48 business hours and may suspend or delete the account concerned.

7. Prohibited uses

You undertake not to:
- use the Service for unlawful or fraudulent purposes;
- create an account in someone else's name or impersonate anyone;
- use the Service to monitor a person without their knowledge or against their will;
- attempt to access another user's data, circumvent security measures, or disrupt the Service;
- scrape, reverse-engineer, decompile or modify the app, except as permitted by law;
- use the Service for commercial purposes, resale, or making it available to third parties;
- use the Service in breach of applicable export control and international sanctions rules.

8. Intellectual property

The Wenly app, its code, design, interface, texts, illustrations, databases and distinctive signs are the exclusive property of the Publisher and are protected by French and international intellectual property law.
We grant you a personal, non-exclusive, non-transferable and revocable right of use, limited to using the Service in accordance with these Terms. Any unauthorised reproduction, representation, adaptation or exploitation is prohibited.
Some visual assets come from the Freepik platform and are used in accordance with its licences.

9. Availability, changes and interruption of the Service

We endeavour to keep the Service available, without guaranteeing continuity or freedom from error. The Service may be temporarily interrupted for maintenance, updates, or due to an event beyond our control (provider outage, network incident, force majeure).
We may develop the Service and add, change or remove features. If we remove a substantial feature included in the Premium subscription, we will inform you beforehand and you may cancel under the Terms of Sale.
We may decide to discontinue the Service. In that case we will inform you at least 60 days in advance by email and in the app, and enable you to export your data before shutdown.

10. Suspension and termination

By you: you may stop using the Service at any time and delete your account directly from Settings > My account > Delete my account. Deletion is irreversible and erases your data as described in the Privacy Policy. It does not cancel a subscription taken out through the App Store or Play Store, which must be cancelled separately (see Terms of Sale, section 7).
By us: we may suspend or terminate your account, after informing you and except in cases of urgency or legal obligation, in the event of a serious or repeated breach of these Terms, fraudulent use, or conduct harming the security of the Service or the rights of other users. If we terminate without fault on your part, we will refund the unused portion of a current subscription on a pro rata basis, to the extent the distribution platform allows.

11. Liability

The Service is provided as is. We do not warrant the accuracy of predictions or the suitability of the Service for any particular purpose.
We cannot be held liable:
- for decisions taken on the basis of information displayed by the Service, in particular regarding contraception, fertility or health;
- for data loss resulting from deletion of your account, uninstallation, or a failure of your device;
- for your partner's use of the Service, or their disclosure of shared information;
- for damage resulting from your own breach of these Terms.
Nothing in these Terms excludes or limits our liability for fraud, gross negligence, personal injury, or where the law prohibits such exclusion. As a consumer, you retain the benefit of all mandatory statutory guarantees applicable in your country of residence.

12. Changes to these Terms

We may amend these Terms. Where a change is substantial, you will be informed by email and by an in-app message at least 15 days before it takes effect. If you do not accept the new terms, you may delete your account before that date. Continued use of the Service after the effective date constitutes acceptance.

13. Governing law and dispute resolution

These Terms are governed by French law.
If you reside in the European Union, the United Kingdom, or another country whose law grants you mandatory consumer protections, this choice of law does not deprive you of those protections.
In case of difficulty, please contact us first at contact@wenly.fr so that we can seek an amicable solution. We respond within 48 business hours.
Consumers residing in the European Union may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr
Failing an amicable resolution, the dispute may be brought before the competent courts. As a consumer, you retain the right to bring proceedings before the courts of your place of residence.

14. Miscellaneous

If any provision of these Terms is held void or unenforceable, the remaining provisions remain in full force.
Failure to enforce a breach does not constitute a waiver of the right to do so later.
